A team looking to hire in Spain

A Latin American company wants to hire in Spain without a local company yet. It must distinguish incorporation from employer registration.

The first question to resolve

Which registrations does this foreign company need, and what classification should it assess?

What to prepare for the conversation

Gather home-company information, activity, location and job duties. Request separate analyses of incorporation, employer registration and applicable collective agreement.

Checklist for your operation in Spain

  • Check Social Security company registration instructions.
  • Validate the applicable agreement and classification with local advisers.
  • Explicitly review any intermediary's proposed structure.

The starting point

To hire someone who will work in Spain, first define the working relationship: duties, autonomy, duration, workplace and who will manage it. This information helps you evaluate alternatives with a local professional.

Independent contracting, direct employment and Employer of Record are not interchangeable based on price. The arrangement depends on the actual work, company structure and applicable framework. This page does not confirm that all options are viable for your case.

Independent contractor: services with real autonomy

A service agreement requires reviewing deliverables, operational independence, invoicing and payments. The contract's title alone does not determine the nature of the relationship.

Before choosing it, document who sets working hours, how work is supervised, which tools are used and whether the person can serve other clients. Seek local advice and avoid classifying dependent work as independent just to reduce costs.

Direct employment: your business as employer

In this scenario, your company manages the employment relationship and must confirm which registrations, payments and obligations apply in Spain. An existing entity may be a starting point, but it is not necessarily ready to employ people.

Request estimates for pay, benefits, employer charges, administration and termination. Assign owners for payroll, documentation and team inquiries, and account for ongoing operating costs.

Employer of Record: assess the structure and scope

An EOR provider offers to act as employer within an agreed structure. Before comparing fees, confirm the structure's viability with local advisers in Spain, the employing entity and each party's responsibilities.

Request a written proposal with administrative fees, deposits, exclusions, payment schedules and exit terms. A platform's commercial presence alone does not prove its service is appropriate for the activity.

Do you need a local entity?

This page cannot give an automatic answer. Distinguish incorporation, employer registration and other obligations arising from operating in the country. Company location, job duties and chosen structure can change the assessment.

Inputs for comparable proposals

  • Confirm where the person will physically work and whether their residence may change.
  • Define payment currency and frequency, and who covers fees or conversions.
  • Ask every provider to quote the same scenario.

From monthly pay to a real budget

The calculator multiplies monthly pay by headcount and shows a twelve-month baseline. It does not add employer charges, extra salary payments, benefits or unverified fees. It also does not convert EUR to other currencies.

Use this baseline to identify missing items and request a complete budget. Comparing figures with different scopes may lead to the wrong decision, even when the apparent difference is small.
